Wohnen Sie in Österreich? Oder sind Sie Österreichische(r) Staatsangehörige(r)? Oder haben Sie in Österreich geheiratet? Oder ist Ihr Kind in Österreich geboren? Wenn die Antwort auf eine dieser Fragen “ja” ist, dann denken Sie vielleicht, dass Sie sich auch dort scheiden lassen müssen, oder dass Sie dort einen Antrag auf Kindesunterhalt anhängig machen müssen. Das stimmt aber nicht immer, insbesondere dann nicht, wenn Sie eine sogeannte “Internationale Familie” sind und eine Verbindung ins Ausland, z.B. nach England haben.
Besprechen Sie mit uns, wo Sie ein Verfahren einleiten sollten und zwar insbesondere dann, wenn Sie oder Ihr Ehemann und/oder der Vater Ihres Kindes in England wohnen oder eine andere Verbindung nach England besteht. Manchmal kann man Verfahren in mehr als einem Land einleiten und zwar unabhängig davon, wo Sie jetzt wohnen oder wo Sie geheiratet haben. Wenn das der Fall ist, dann muss man prüfen, in welchem Land man das Verfahren am Besten einleitet. Der Grund liegt darin, dass man nur eine eine Scheidungsklage oder einen Antrag auf Kindesunterhalt stellen kann und die Ergebnisse sehr unterschiedlich sein können, je nachdem, in welchem Land das Verfahren anhängig gemacht wird. Bedenken Sie auch, dass Ihr Ehemann auch ein Verfahren einleiten kann, Ihnen also zuvor kommen kann. Insofern ist es wichtig, schnell aber richtig zu agieren.

Do you live in Austria? Or are you an Austrian national? Or you got married in Austria? Or your child was born in Austria? If that is the case then you may think that that means that you must also get divorced in Austria or that you can only issue a claim for child maintenance in Austria. However, that is not necessarily true if you have a connection with England & Wales.
Check with us first where you could issue proceedings, in particular if you, your husband or the father of your child resides in England. Sometimes, and in particular in many international cases, it is possible to issue proceedings in more than one country, for example in Austria and in England irrespective of where you now live or got married. And if that is the case then get advice from us as to where it is better to issue a divorce or an application for child support. Because you can only issue one divorce petition or one claim for support for your child although the outcome of the proceedings can be very different depending on which court in which country will deal with your case.
